Last Revision: July 17, 2008

This privacy policy (the “Privacy Policy”) applies to your use of the www.dormgear.com website (this “Website”), which is operated by Dormgear (“Dormgear”, "Dormgear.com", “us”, “our” or “we”). We take your right to privacy seriously. We want you to understand what kinds of information we gather from you, how we collect such information, how it is used and protected, and how you can control its use. Except in the limited circumstances set forth herein, we do not have a practice of sharing any of your personal information with any third parties. While this Privacy Policy applies to the collection and use of information by us through this Website, it does not apply to information that you may send to us by other means.

By using this Website, you agree, without limitation or qualification, to be bound by this Privacy Policy. Please take the time to read our Privacy Policy. Even print out a copy for some reading bound to put you to sleep faster than your Computer Science 101 textbook.

1. Information Collected

A. Personally Identifiable Information Collected by Us:

“Personally Identifiable Information” includes any information which can be used whether alone or in combination with other information to identify you. When you submit a rating, send an email, view pages, or generally waste time on this site, we may require or ask you to give us certain personally identifiable information. We may also collect other Personally Identifiable Information which you volunteer to us through use of our service, or when filling out surveys and/or forms on this Website. If you place an order for goods on this Website and/or through our Business Partners (as defined below), you may be required to enter your credit card number and other information such as your shipping address and/or other contact information. You may always choose not to provide such Personally Identifiable Information; however, this may limit your ability to fully use our website and our ability to provide you with a specific service or particular content. We may also collect non-personally identifiable information from you and or through your use of this Website. Such non-personally identifiable information may include demographic and other aggregate data. For example, collecting this data my assist us in preventing you from making duplicate votes on our site.

B. Personally Identifiable Information Collected by Our Business Partners:

Dormgear works with third-party advertising companies, web stores, sponsors (the more, the better, right?) and other companies with whom we do business (“Business Partners”), including without limitation, to process purchases made on or through this Website, place advertising on this Website and in email communications sent to our registered users and to recipients of invitations or notices related to our services. Information about your visit to this Website, such as the number of times you have viewed an ad, may be used to serve advertising to you on this Website or for general Website diagnostics and improvement.

Dormgear may correlate or match information you volunteer to us, including Personally Identifiable Information, with information held by our Business Partners to target ads or otherwise improve the effectiveness of our service. Our Business Partners may read or set cookies on your hard drive (see Subsection D below for more on cookies, as well as apologies for that unfortunate name), use pixel tags (see Subsection F below for more on pixel tags), track which ads you have viewed, or collect other information about you.

From time to time, Dormgear may also offer some arguably sweet deals and promotions that are sponsored by a Business Partner. In order to participate in these offers, you may be required to follow a separate registration process. You may consent to receive information from a Business Partner, through an opt-in or opt-out process, and are then liable to said partner’s agreements.

In some cases, we may enter into a promotional relationship with a Business Partner in which we prominently display their brand name or trademarks on pages that appear the same as or very similar to the pages of Dormgear or our services. These pages are known as “Co-Branded Pages” and these particular Business Partners are known as “Co-Branded Business Partners.” If the page on which you submit Personally Identifiable Information is a Co-Branded Page, or was accessed by clicking on a link on a Co-Branded Page, then we may share your Personally Identifiable Information with the associated Co-Branded Business Partner. Co-Branded Business Partners may use your Personally Identifiable Information in accordance with their own privacy policies. You will need to contact the Co-Branded Business Partner to instruct them directly regarding your preferences for the use of your Personally Identifiable Information by them. Additionally, you agree that we may use and disclose all such Personally Identifiable Information so submitted to such Co-Branded Business Partners in the same manner in which we are entitled to use and disclose any other information you submit to us (see Use of Your Personally Identifiable Information by Business Partners below).

C. Contact Information:

If a service is offered by which you may suggest a page to a contact, or communicate with a contact via email or some other means offered on our site, we require that you submit to Dormgear a current valid email address for each of your contacts. When you send messages to your contacts through our service (e.g., suggesting a product), we may collect and retain the email addresses or other pertinent contact information of those persons to whom you send the message. Except as described below in the Section titled “When We May Disclose Your Personally Identifiable Information or Data”, we do not sell, share or otherwise provide the contact information you submit to Dormgear to any third party.

D. Cookies:

Dormgear and/or its Business Partners may optimize your experience to ensure that the most relevant information, promotions and offers are displayed to you while using this Website. A common manner in which to do this is by placing cookies on your computer. These aren’t cookies of the girl scout variety, dumb-ass. These cookies are strings of text and numbers that can identify your computer to us when you visit our site, and which may be correlated with your Personally Identifiable Information in our log files. For example, in the event you note your school, should we start collecting this info, and you haven’t saved it via any other method (such as registering with Dormgear), we may cookie your school. We assure you that this is the only context in which we will ever utter the phrase “cookie your school.” If you wish to prevent us and/or our Business Partners from setting cookies on your browser, you may set your browser to refuse cookies or to warn you before setting a cookie. Although disabling cookies by companies whose products or services are advertised on this Website should not affect your ability to use this Website, disabling cookies set by us may, in fact, limit your ability to use or otherwise impair the effectiveness of our services.

E. IP Address:

When you visit this Website, we may log standard information such as your IP address, which is a number that can be used to identify your location and Internet Service Provider, along with the URL from which you came to this Website and the URLs visited on this Website. A URL is the full address of a website page, which may or may not contain some Personally Identifiable Information about the person who is viewing it.

F. Pixel Tags:

Dormgear and/or its Business Partners may use pixel tags to gather information about the emails and advertising we send to our registered users and to recipients of messages. Pixel tags are tiny graphic files, not visible to the human eye, that may be included in our HTML-encoded emails and advertisements. When such an email is opened in an HTML-capable email program, or a page is opened that has a pixel tag, the recipient's computer will access our server to retrieve the pixel tag file, allowing us to record and store, along with your email address or IP address as applicable, various information, such as a reminder or advertisement, and other standard logging information. The pixel tag also may see or read cookies. If you are geeky enough to want more information about cookies and how to disable their use, see the section below on “Use of Cookies.” Frankly we think you’d have more fun Googling “Eva Longoria,” but then again, it’s a free country.

2. Use of Information

B. Use Of Your Personally Identifiable Information By Other Users:

We encourage you to read the privacy statement of any website you may visit before providing personal information to them.

Dormgear does not sell, share or otherwise provide any contacts' (as when you suggest a page) contact information you give to us with any Business Partner, unless required by law, court order or as required to technically operate our services.

E. Use Of Cookies:

We may use cookies to deliver content specific to your interests, among other purposes. Our Business Partners may also use cookies. Cookies which are received with banner ads are collected by our Business Partners, and we do not have access to this information. We do not control our Business Partners’ use of cookies nor do we typically have access to the information contained in or related to those cookies. Please contact our Business Partners directly for more information about their privacy practices.

F. Use Of IP Addresses:

However, even if you opt-out, Dormgear may disclose your Personally Identifiable Information, the contents of your private communications, or the contact information of your contacts if required to do so by law or court order, in order to perform a service requested by you, to complete a transaction such as the fulfillment of an order or purchase placed by you or as contemplated in the last paragraph of this Section 3.

Also, certain technical processing of email messages and their content may be required to: (1) send and receive messages; (2) conform to connecting networks' technical requirements; (3) conform to the limitations of the Service; or (4) conform to other similar requirements.

It is possible that as we continue to develop this Website and our business, Dormgear and/or related assets might be acquired. In such a transaction, customer information, including Personally Identifiable Information, may be transferred to the acquiring entity.

4. Security

We have put reasonable physical, electronic and managerial procedures into place in order to help safeguard and prevent unauthorized access, use and/or disclosure or your Personally Identifiable Information. Although we use reasonable efforts to safeguard the security of your Personally Identifiable Information, transmissions made on or through the Internet and Personally Identifiable Information stored on our servers or the servers of third parties that we use are vulnerable to attack and cannot be guaranteed to be secure. In addition, submissions made via email are not protected by encryption and are vulnerable to interception during transmission.

Please be aware that these websites of our Business Partners, Co-Branded Partners and third parties may collect Personally Identifiable Information about you, and operate according to their own privacy policy practices which likely differ from our own Privacy Policy and collection practices. Please contact those companies directly for more information about their privacy practices. We are not responsible for the privacy practices or the content of such websites, nor do we make any warranties or representations about the contents, products or services offered on such websites or the security of any information you provide to them. We encourage you to read the privacy statement of any website you may visit before providing personal information to them.
